Edward specialises in most areas of chancery and commercial work as part of his busy practice. Chambers and Partners (2012) recommends him as an 'up and coming' chancery junior who is "surely destined for great things" and he has been described as a "rising star" by Legal 500, which also recommends him as a leading junior for insolvency work. Edward read Law at Downing College, Cambridge where he was President of the Cambridge Union. After leaving Cambridge he was a Thouron Fellow at the University of Pennsylvania, studying at both the Law School and Wharton Business School. He then became director of a group of engineering and property management companies, acquiring a practical understanding of the commercial realities of business and, in particular, company law, before completing pupillage at XXIV Old Buildings.
He frequently appears in trials before the High Court and County Courts as well as in arbitrations and has extensive experience of interlocutory hearings, petitions and other applications. He is also regularly asked to give advice, both orally and in writing, to settle pleadings and to draft other documents as part of his busy practice.
Edward has twice been retained by one of the leading offshore firms for an extended period of time to advise its Guernsey business and trust law department on a variety of matters, reflecting the strong reputation of XXIV Old Buildings in offshore and trust work.
His recent work includes:
- ACG Acquisition XX LLC v Olympic Airlines SA (in special liquidation) [2012] EWHC 1070 (Comm): the first case to consider the meaning of 'airworthiness' of an aircraft. Edward, led by Philip Shepherd QC, represented Olympic Airlines at the Commercial Court trial of this US$17million dispute over a Boeing 737-300 which was found to have been unairworthy at the time that it was delivered to the Greek flag carrier airline.
- Thomas & Pick v Jakes & Nestarec [2012] All ER (D) 131, [2012] EWHC 525 (Ch) and [2011] EWHC 2619 (Ch): acting as sole counsel Edward successfully pursued an application to commit two company directors to prison for contempt of court in transferring bearer shares to a third party, despite an order that they deliver them up to English liquidators, and deliberately deceiving the court at an earlier hearing by advancing a false case. Each respondent was sentenced to 1 year's imprisonment.
- Major trust litigation, which settled partway through a lengthy trial in the Chancery Division in early 2011, by which one of four trusts claimed to be entitled to exercise a right of pre-emption in relation to another trust’s interest in companies owning a substantial London commercial and residential property: see Fattal and others v Walbrook Trustees (Jersey) Ltd and others [2011] 1 All ER (Comm) 647, [2010] EWHC 2767 (Ch) and [2010] EWHC 3049 (Ch). Edward was led by Alan Steinfeld QC and Elspeth Talbot Rice QC.
- Keegan v Fitzgerald (2011) LTL AC0130343: Edward successfully obtained summary judgment on behalf of the defendant in this bitter partnership dispute. The case concerned an attempt by one partner in a joint venture to recover a sum said to be owed by the defendant by way of a debt claim rather than by the taking of an account in equity. An appeal is to be heard in June 2012.
- Chapman v Wilson, Pitts and LawFinance [2010] EWHC 1746 (Ch), [2010] All ER (D) 178: Edward appeared on behalf of the successful defendants in the week-long Chancery Division trial of this multi-million pound challenge to the validity of a lender's security over various assets (including debts and work in progress) of a troubled solicitor’s firm. The case raised novel questions about the steps necessary under the Bills of Sale Acts to perfect and allow enforcement of various types of security over an individual's asset.
- Griffin v Griffin (2010): Edward appeared at the much-publicised trial of this dispute between two brothers over a debt alleged to arise from the administration of their mother’s estate.
