Marcus specialises in private and commercial trusts and funds and company litigation and he is experienced in international commercial disputes resolved both in litigation and by arbitration.
After spending 4 years in the 1990’s working for Switzerland’s leading business law firm, where he was involved with ICC, LCIA and ad hoc arbitration disputes, Marcus joined XXIV Old Buildings. XXIV's international practice profile was an important reason for Marcus's move and has helped him develop a focus on off-shore litigation.
Marcus has particular expertise in private and commercial fund related disputes involving the duties of investment managers, trustees, banks and other financial intermediaries and the directors of such entities, and the rights of investors and beneficiaries. This work typically involves disputes affecting trust and corporate structures designed for outside investors in managed funds using banking services.
Marcus has been instructed in cases where the disputes have centred on trusts and companies in a variety of jurisdictions including the Cayman Islands, the Isle of Man, the British Virgin Islands, Jersey, Guernsey, Cyprus, the Bahamas, and Anguilla. He has also worked with international teams of lawyers in Texas, New York, Switzerland, France, Germany, Greece and Italy and has considerable experience of inter-jurisdictional issues of ancillary relief (injunctions; foreign receivers; attachment orders) and enforcement.
These disputes have turned on issues of shareholder's and noteholder's rights, directors' and investment managers' liability, domestic and international insolvency, regulatory compliance, civil fraud (with asset tracing and recovery) and Marcus has acted for parties including claimant investors, beneficiaries and trustees as well as defendant banks, investment managers and trustees.
