Francis Tregear QC’s practice centres on the core areas of business disputes, company and insolvency matters, funds and financial products, property litigation and trusts.  

He brings a detailed understanding of the commercial and financial issues affecting clients. He is an effective advocate in court and on paper and is quick to see how a case can best be presented to advance the client’s interests. The key to a successful resolution of all disputes is a detailed understanding and interpretation of the agreements and principles which underlie any dispute. Francis’s practice demonstrates his success in these critical areas. 

In 2007 and 2008 Francis has been involved in Hedge Fund work covering both litigation and advisory work. For the past year he has been working in major litigation in the Cayman Islands relating to provisions in a fund’s structural documentation relating to gating redemptions and redemption management. He has also advised a number of different funds (based in the Cayman Islands and the British Virgin Islands) on redemption-management provisions in their articles and offering memoranda. At present he is been advising a number of US based funds which had prime brokerage relationships with Lehman Brothers as to their position in relation to the current administration.  More generally, he also has experience of litigating and advising in respect of margin trading products in the UK.

He acted for trustees in connection with the liquidation of two Bear Stearns hedge funds. He was also successful in defending a CPIM Structured Credit fund against a claim for summary judgment based on contested redemptions.  

Francis acts for clients across a broad spectrum of commercial activity and is currently instructed in a large group litigation action for a group of over a hundred claimants.
